The two parties involved in a tort case are plaintiff who sues and a defendant who stands accused (Michael, 2010). In this scenario, different persons can be considered as potential plaintiffs due to acts that happened to them. First, Malik is a potential plaintiff as he can sue Daniel for shoving him and as a result he losses two of his front teeth. Daniel is a potential plaintiff and can sue the lady who accused him of giving beer to his child in front of his boss making him to lose his job. Daniel is also a plaintiff in a potential case against the concession worker for giving him and Reuben a sugary soft drink which causes Daniel to slip in a diabetic coma. Malik’s wife is a potential plaintiff as he can sue Daniel of causing her emotional distress of seeing him shoot her husband. On the other hand, Daniel is a potential defendant if he is sued by Malik for making him lose his teeth, shooting him and if sued by Malik,s wife. The other potential defendants are the lady who accused Daniel of giving beer to his son Reuben and the concession worker who due to negligence gave them sugary drinks instead of soft drinks. The elements of the tort claim that constitute the plaintiffs claim are the false comments that are made by the lady concerning Daniel giving beer to his son and the fact that Daniel boss heard this and decided to fire Daniel. Then clam against concession worker involve an act of negligence when she gave Daniel sugary drinks and later fell in a diabetic comma. Daniel might argue that the first act against was due too provocation and he shot him in the process of self defense. The lady who yelled to Daniel at a concession store may prove that she had actually smelled beer on Ruben. In the resolution of this claim, there will be a need to analyze the claims and isolate the causes and effects of each case. Daniel may be absolved from any wrongdoing as all his acts have a genuine reason behind them. An act of self defense is recognized buy law. The worker at the store may face the legal consequences.
